Alys Tours Affiliate Program Contract

This contract governs the commission, payment and promotion terms for participants who refer customers to Alys Tours through their personal link. Individuals who do not own a company, influencers and content creators may also join the Program. There is no requirement to own a company or to have a minimum number of followers.
1 Parties and contact

1.2 The Participant is the person whose details appear on the application form and who accepts this contract. For participation on behalf of a company, the company details and the authority of representation are notified separately. The term “Participant” also covers individual participants.
2 Participation conditions
2.1 Participation is free of charge. Natural persons must be at least 18 years old and have the legal capacity to enter into a contract. The Participant accurately provides their first name, last name, telephone and email address and, if any, the company name and tax details relating to the application.
2.2 Alys Tours evaluates the application and assigns a personal affiliate link to the accepted Participant. The contract enters into force upon the Participant’s acceptance and the activation of the link. The Participant notifies changes to their details without delay.
2.3 The Participant may share their own link on their social media accounts, website or other lawful channels. The Program does not promise a specific number of bookings, regular income or guaranteed earnings.
3 Scope of the Program
3.1 The Program covers all products on the Alys Tours website. Commission applies only to bookings that are referred via the personal link, completed on the website and matched to the Participant. Bookings completed by telephone or WhatsApp are outside the scope.
3.2 The Participant carries out promotion and referral. The Participant may not receive payments, confirm bookings or enter into contracts on behalf of Alys Tours, or give commitments regarding unapproved prices, discounts or services. The customer’s booking and service relationship is subject to its own terms of sale.
3.3 This contract does not create employment, a company partnership, exclusivity or authority to represent Alys Tours. It does not grant authority to carry out travel agency activities that require a certificate or permit. The mandatory statutory provisions applicable to the actual activity are reserved.
4 Link and 30-day tracking
4.1 After clicking the personal link, the visitor is matched to the relevant Participant for 30 days. If, within this period, the visitor clicks the links of more than one participant, the last valid link clicked is taken as the basis and the 30-day period starts from that click.
4.2 The booking must be completed on the website within this period; the service being provided at a later date does not prevent the commission entitlement. A click or a registration on the site does not by itself give rise to commission. No indefinite entitlement arises over all subsequent transactions of the customer.
4.3 Cookie preferences, a change of browser or device and technical problems may affect matching. The Participant may report a missing record with the booking reference and lawful supporting information. Alys Tours reviews the records and gives a reasoned response within 15 business days; in the event of a necessary extension, it notifies the reason and the new response date. The records are not deemed the sole and conclusive evidence.
5 Commission and entitlement
5.1 The commission is 3% of the VAT-inclusive booking price actually paid by the customer after discounts. The same rate applies to all products. For example, for an eligible booking of 10,000 TL, a gross commission of 300 TL is calculated. Alys Tours’ supplier or operating costs are not deducted from the base.
5.2 The commission becomes final after the tour, activity, transfer or related service has been performed, provided that the price has been collected. Bookings not yet performed are shown as pending transactions. No commission arises in the case of full cancellation and full refund; in the case of a partial refund, it is recalculated on the net payment for the service remaining with the customer. Cancellation or no-show fees charged without the service being provided are not included in the commission.
5.3 If a refund or chargeback occurs after payment, Alys Tours notifies the relevant transaction and the calculation. Once agreement is reached on the overpaid commission, it is set off against the next entitlement; if there is no entitlement, a reasonable repayment schedule is determined. Statutory rights of recourse are reserved for the disputed portion.
6 Payment period and currency conversion
6.1 If the total gross commission balance that became final by the end of the previous month and has not yet been paid is at least 1,000 TL, payment is made between the 1st and 7th days of each month. If the last day falls on an official holiday, the first following business day applies. A balance below the threshold is not cancelled; it carries over to the following months.
6.2 Payments are made in TL. The 3% commission on a foreign-currency booking is first calculated in the currency in which the booking was collected; it is converted into TL at the latest CBRT (TCMB) foreign exchange buying rate published at the time of payment. For the threshold check, the last rate published on the first business day of the month is used; a balance included in the payment is not postponed due to a subsequent fall in the exchange rate.
6.3 Payment is made to a bank account registered in the Participant’s own name or to a legally compliant digital payment account accepted by the parties. If the tax status requires a specific bank account, only that account is used. If the necessary payment details or financial documents are missing, the deficiency is notified; payment is made within 7 business days at the latest after it is remedied.
7 Account statement and tax status
7.1 There is no participant panel. Alys Tours sends an account statement to the registered email address in the first week of each month. The statement includes the booking reference, service date, transaction status, commission base, 3% commission and, if any, refund, exchange rate, deduction and carried-over balance. Unnecessary customer identity and contact details are not shared.
7.2 Owning a company is not a condition for participation; however, this does not mean that the earnings are automatically exempt from tax. The Participant provides accurate information about their tax liability and, if any, their exemption certificate. The necessary documents and deductions are applied according to the nature of the activity and the person’s tax status; an invoice is not unconditionally required from everyone.
7.3 A Participant who meets the conditions for benefiting from the exemption in repeated Article 20/B (mükerrer 20/B) of the Income Tax Law notifies the exemption certificate and the bank account used for this purpose. Payments within this scope are made to the specified bank account; no digital payment method that would breach the exemption conditions is used. Participation in the Program does not by itself confer entitlement to the exemption.
7.4 The amount calculated at the 3% rate is the gross entitlement. The net amount credited to the account may differ due to legally required tax deductions. If VAT must be applied to the Participant’s commission service, the VAT within the 3% gross entitlement is shown separately in the financial document. Alys Tours does not make deductions without a legal basis; deductions are explained in the statement. Alys Tours’ transfer costs are not deducted from the commission balance.
8 Promotion and paid advertising
8.1 The Participant may advertise with their own budget; responsibility for the spending and the advertising account lies with them. Alys Tours does not undertake to provide an advertising budget or to reimburse spending. Advertising must comply with platform rules, the legislation and this contract.
8.2 The commercial relationship is clearly disclosed. Example: “Ad / Alys Tours collaboration. I may earn a commission on bookings made through this link.” The disclosure must be easily noticeable; the written, visual or verbal notices required by videos, stories and other channels must be made.
8.3 The Participant may not announce untrue prices, discounts, availability or guarantees; may not use fake reviews and may not present a service they have not experienced as if they had experienced it. The Participant may not open an account or domain name that gives the impression of being an official Alys Tours account. The Participant may not carry out promotion that is fraudulent, discriminatory or unlawful, or that associates the brand with such content.
8.4 Spam, unauthorized bulk commercial messages, fake traffic, bots, hidden or forced redirects, placing tracking cookies against the user’s will, and appropriating another participant’s commission are prohibited. The Participant obtains the necessary rights and permissions for the third-party content they use.
8.5 The logo and promotional materials provided by Alys Tours may be used only for the Program, without modification and for the duration of the contract. The Participant corrects without delay any incorrect or outdated information they become aware of. Alys Tours communicates the advertising rules and takes the necessary measures against violations it detects.
9 Violations and brand protection
9.1 In the event of a specific violation, Alys Tours may request the removal or correction of the relevant content; it may temporarily suspend the link. In the event of fraud, unauthorized collection of payments, a serious data breach or unlawful promotion that seriously damages the brand, it may terminate the contract immediately. For other remediable violations, it grants a 7-day correction period.
9.2 Alys Tours may resort to legal remedies to stop unlawful acts and to obtain compensation for provable damage caused through fault; where the conditions exist, it may make notifications to the competent authorities. Commission may not be withheld solely on the basis of a subjective “brand damage” assessment without a specific violation. Lawful criticism or the pursuit of rights does not by itself constitute a violation.
9.3 During a review, only the commission relating to the suspicious transactions is withheld; the reason is notified to the Participant and their explanation is obtained. The review is concluded within 15 business days; a necessary extension is notified with its reason. Unrelated final entitlements are paid. The parties are liable for their culpable violations in accordance with the applicable law.
10 Confidentiality and personal data
10.1 The Participant does not collect card, passport or other personal data from the customer for the booking; the Participant refers the customer directly to Alys Tours. The parties use non-public commercial information only for running the Program and do not disclose it to unauthorized persons.
10.2 When collecting application and payment data, Alys Tours provides a separate KVKK (Turkish Personal Data Protection Law) privacy notice. Acceptance of the contract is not a marketing permission or a general consent to data processing. Any necessary explicit consents are obtained separately. The parties provide the necessary information and legal bases with respect to the cookie and data processing activities on their own channels.
11 Leaving and amendments
11.1 The contract is of indefinite duration. Either party may terminate it with 15 days’ prior written notice. Upon termination, new referrals are stopped. Eligible bookings completed beforehand give rise to entitlement even if the service is performed later. Valid clicks made before termination are preserved for the remaining 30-day period, unless the match changes to another link.
11.2 The Participant removes the active promotions and brand materials under their control. The final balance of a terminated membership is paid in the next payment period without applying the 1,000 TL threshold, provided that the necessary financial documents and payment details have been completed. Pending bookings are settled by the same method as they become final.
11.3 Changes to the commission, tracking and payment terms apply prospectively upon explicit written or electronic acceptance. Silence is not deemed acceptance; the rights relating to previous eligible bookings are preserved. Notifications are made to the registered email addresses; for transactions for which a special form is required by law, that form is complied with.
12 Law and acceptance
Turkish law applies; the courts and enforcement offices having statutory jurisdiction and competence are authorized. Mandatory mediation provisions are reserved. The Participant accepts the contract by signature or by recorded electronic acceptance. The accepted version and text are kept accessible and a copy is sent to the Participant.
